Can an Insurance company still be held liable for the after affects of a car wreck?

Any advice is greatly appreciated. My problem is this, In July 2007 A man in a huge truck with a trailer hinge back up out from a parking space, it I saw him and the only thing I could at the time is speed up so he would not hit the middle of my car. He ended up hitting the side bumper and ripped it off. I have A 1999 Cryshler Sebring. It truely was a hard hit. Well the man's insurance did pay to fix the bumper, but now everything keeps going wrong. I did mention it to the person at the shop where we had arranged for the repair. I asked to please give me an estimated how much it would cost to fix it. When the time came, She did not do so and when I asked the lady she gave me a look like there is really something wrong with my car. I give two guys a ride to the bus so they do not have to walk the mile or so and they can attest that my car was running smooth. So many things one after another have gone wrong. I have put over 700.00 and still more problems. So my question is what do you think my chances are If I take it to the manufactor and they will rule in my favor. The Insurance Co-ordinator says if they say it was from the accident then they will pay for it. Straight from the start right after the accident my car kept dyeing out, so I had to drive it like a standard car with my feet on the gas and brake at the same time. So in the end , last I have heard there is a short somewhere so I took it to Spitfire and place that specializes in electrical problems and he told me my computer is bad. First of all the things my battery kept dyeing out, my car would not start up in the mornings,I took it to Auto zone and my battery was fat, swollen no good. Bought a new one, then I took it to a man at midas , he said I needed a valve cover gasket and he showed me my spark plugs we filled with oil, fixed that. Now Midas ran a scan and said I had either a bad map sensor or a short. Changed the map sensor the car is still barely running, so then another place said it was a short but had it for two weeks and could not find the short . I would like to know , if the guys Insurance is still on the hook for all the problems I have had with the car since the accident. Now I give these two guys a ride from work each day and they knew there was nothing wrong with my car before the accident. What is the best thing I can do. Many thanks , Sylvia

The cheapest quote I had found (through Geico I believe) is $585/month for full coverage.. that's over $7000 a year... I have two tickets on my record. That quote was done without listing any tickets at all. I work 65 hours a week, so the only place I really drive is to my jobs and back. What do I do if I've been denied life insurance?

I'm young(18) I don't smoke or drink, and I don't have cancer, or tumors or anything. Well except epilepsy. I also have a physical disability. I can understand epilepsy being a concern, but I fail to see how anyone can be denied with my physical disability. As it does not in any way shorten your life span. Is this fair? I guess I also have partial blindness. But, it's just a visual cut, not my entire eye or anything. Is there anything I can do? I do have a wife, and plan on having kids soon. I don't want to hear about me being young unless this is related to the reason, or there is a better option. Also, there is NO medical conditions that would be caused by my disability in the future. I've always had full coverage insurance but since I switched carriers it was one thing after another ... Add them as lien holder -done, didn't receive notice from insurance company, didn't receive fax with notification, etc. .... Just this Monday I found out I was pregnant. Two Clear Blue PREGNANT's, and I was bawling in the Target bathroom. I all ready have two children, both of which are on ALL Kids because my husband didn't want to keep our health insurance last year due to the rising costs (like, it kept going up $100/year, and towards the end, we were paying $500/month). So now I'm pregnant, no health insurance, and pretty much stressing out over it. I will apply for SOBRA Medicaid (something I found on Alabama's Department of Health site) after my doctor's appointment next Wednesday, but if they don't accept me, then I don't know what else to do. Giving my baby away is not an option, neither is abortion. I will love this baby no matter what happens. i have had my license for a little over 2 years now. I got a new auto insurance last November and it expires end of May. I paid $320 for 6 months. The rate was higher due to a moving violation. Well, the violation is off my record now.... and when I got a quote today with another insurance company, it was $150 for 6 months. I'm 19, and the car I was driving was constantly breaking down. When it was completely broken for two months, I stopped paying my insurance and instead saved back money to get the car fixed. My insurance canceled during that time. When I got it fixed on Friday, I was planning on renewing my insurance Tuesday, a day I had off work. I am the 3rd occasion, and he hit me, He was drinking,which he got field sobriety test and breathalizer at the scene because we/the cop and I could smell the alcolhol.He was charged with Reckless. I m going to get a copy of the accident report. I am so angry that this guy was drinking, and has made a habit of doing this! I was hit by a woman in a parking lot. In Texas where I live, certain parking lots are no fault zones if they are private property. I was in one of these no fault zones. I was uninsured at the time. She had Uninsured Motorist Protection as part of her insurance policy. I suffered no damages to my vehicle or person. She suffered $1500 worth of vehicular damage. Her insurance company paid for her damages. I was backing out of a parking space and she came flying around the corner and messed up the entire passenger door of her car on my rear bumper. Like I said I received no damage to my vehicle since I was the one barely moving. She called the police immediately after this minor accident took place. I was not cited on the ticket I received for any accident, only for no insurance. The officer informed me verbally that the accident was my fault only because she had the right of way but that there was nothing they could do about it because of the no fault zone policy. Anyway, now her insurance company is coming after me to collect payment of the $1500 they paid for her damages. I have not agreed to pay this amount because it was a no fault zone and I don't feel I should pay for it. She should not have been going that fast in a busy parking lot with a car full of kids. Although the unofficial technicality states that I was at fault, legally no one was at fault. Her insurance company is also threatening to have my license suspended if I do not pay the amount specified. I did not think that they, as a private company, had the power to have that happen. I've never been in this situation before and need an answer as to whether or not the insurance company can do that or if its just some kind of scare tactic to jolt me into paying but really has no merit behind it. My car caught on fire due to some electrical wiring, im fully comp, and have never claimed before. But sneaky as they are, they have told me that they do not cover electrical wiring faults, which has caused the fire. But the AA who towed my car in has catergorised it as fire damage. Surely they must cover the fire damage. I took it to a repair centre near me, and have asked them to have a quick check, and they also say its fire damage and what not, this has been procrastinated for so long by the insurance company, (claims company rather) that i can't remember what the repair centre has stated. Surely, fully comp covers something like this? THEIR engineers have said that there was no further damage to the rest of the car, but can i trust THEIR engineers? A full check up costs a lot, as they would have to take apart the car ( i believe? ) When i rang up the lady at the claims centre, she had no idea what case i was on, she literally said 'give me a moment to read up on your case' for me, thats a bit pathetic. While speaking on the phone with her not only was she rude, almost shouting at me (as i pressed on further ) . She told me she would send the company policy booklet to show that electrical wiring is not covered, and a letter stating the case was closed and in detail what the whole case is about. A week and a half has gone by (she said couple of days) This is the most annoying thing. She was rude, unhelpful, unwilling to help, and just taking the pee with the whole thing. I just find it sketchy that the letter has not been made, and no further actions or anything has happened (i have also opened another case about another incident - no info .. still) . I think they are just hoping i'd give this up as they are so unwilling to pay out. This is the reason I have insurance. Whats the point otherwise? Sorry for the long read. I have no idea what to do now, can i take it to a small claims court or talk to someone in the city council to further my case? Thanks

Will insurance cover a new transmission or total my car?

My dad's 2001 Toyota 4Runner recently broke down and the mechanic said it was b/c water got into the transmission and that we would need a new one. We talked to Geico and they said they would cover the transmission cost plus the cost of some converter thing (both got damaged b/c of weather). But now Geico is saying that if the price goes over $1000 they're just going to total the car. The mechanic said it'll be around $5000 and the adjuster hasn't seen the car yet (he'll try today or on Monday), so do you guys think that Geico will definitely total the car? When we first talked to them they said they would cover everything and I'm guessing they know the cost of a new transmission, so I don't understand why they won't cover it anymore.

Rain now gets in through the top as the seal is broken as well. She is insured and believes she has coverage but she's scared cause she left the scene. This was 3 weeks ago - there has been no follow up. She hasn't called the police but kept an eye out for whether or not it was reported and she needed to come forward. It was in a pretty run down part of town. Anyway - I don't know what to tell her so i'm coming here - can she report this to insurance and admit that she swiped a bus and didn't stop? Will they fix it, up her insurance, and move on or will they investigate into the bus - making her pay for the bus and having the legal issue of leaving the scene. - not sure what to tell her??? She's also considering just putting a new skin/shell on the door was affected - not seeing if this is possible though - replacing the entire door is expensive and seems unnecessary. Accident in a WalMart parking lot and the other party's insurance denied my claim... any advice?

Hi everyone, I would appreciate your ideas regarding the following situation: My son had a car accident last week in a nearby WalMart parking lot (Dallas, Paulding County, GA). He was driving down a parking lane and hit a car which came out of nowhere cutting across the aisle. Both vehicles had extensive damage (front of the vehicle on our car, and driver side on the other car). There was a gentleman who saw everything and called 911. The sheriff's deputy arrived at the scene promptly. He explained there would be an accident report, but since this happened in a private parking lot, he was not in a position to state who was at fault. I got the report the other day and it states the facts about the accident and gives the contact information for the witness. I have spoken with the other driver's insurance company three times and I just found out that their claims rep has determined that my son was at fault, so they have denied my claim. The claim with them was actually originally filed by the other driver. I politely asked to speak with a supervisor and was advised that I should expect to receive a call from a supervisor soon. I did not get a chance to talk to my insurance rep after I found out the other insurance denied the claim, but I am not sure if there is anything my insurance can do for us, especially given the fact that we only have liablity coverage on this vehicle (no collision coverage either). I think it is really outrageous how they could claim my son was at fault, if all evidence points to the fact that their insured was driving across the parking lanes and obviously did not see our car. I cannot find anything online (like traffic regulations) that explicitly says that the driver cutting across the parking lanes is at fault if there is a collision, but I think it is common sense that this should be the responsible party! If anyone has had a similar experience, or has any suggestions, your help will be very much appreciated!

hey guys so probably 2 months ago I got my first speeding ticket whilst on the way to the movie theaters at college because my stupid friends wanted to make the 9:30 showing of Evil Dead. At this point I regret making a claim and wish i could turn back the clock. I am being forced into a box and it looks shady. No i am just asking the insurance company to forget everything and drop the claim because the damage is not that extreme and i dont want to lose my car. I am told at this point it is too late. Is that true? My neighbors are floored by this, i have been driving it around for a few weeks just fine and the car still looks new With only 62000 miles on it. I can't help from thinking that something suspicious is going on here. Do they stand to make a nice profit by totalling my vehicle and then replacing one module for a 1000 or so and having a perfect car with all systems working? Also the lady from the claims office said the car had to be 80% damaged for it to be a total loss. I asked her if this was based on speculative problems that they think may occur in the future because of the water, or based on actual damage now? She said it had to be actual damage now but couldn't give me any details from the adjuster yet. Can I demand that the adjuster list everything that he thinks has been damaged to my car (which I am convinced he will have to be creative to do so)? The car as i said drives wonderful, I checked the fluids on my own (fine), and the car looks new. Do I have any recourse here? I just want the car fixed for the one problem, i dont want to lose the car, and at this point I don't even care about having insurance fix the one problem, but again I am told it is too late to go backwards and drop this entire issue. I almost have an inclination to report this because it looks so shady. No reasonable person would look at, and drive this car and consider it a total loss. No proof of insurance question?

So i made a mistake. I was stopped last night and cited by a law enforcement officer for no proof of insurance. I had an idea that my insurance was no longer valid due to it overdrafting from my account when i had no money. so i contacted the insurance company and now they will NOT re-instate the insurance policy due to the fact that i have had two bad overdrafts with them. I completly understand, and like i told the officer, this is my fault...i was poor..... anyways. However now i am hearing im going to loose my license...... So i was told by the driver license department that if i go out now and get an SR22 qualifying insurance plan with a different company, that when i walk into the justice court payment window, they will not take away my license from me? however justice court states that my license will get taken away and i have to bring the proof of insurance to the DMV............and get my license back. I have of course included the at-fault accident in May and I also included the accident that was not my fault. Before these 2 accidents, I had one just one that was in a parking lot. The other driver and I were deemed both at fault, 50/50. Damage to his car was around $700. That was 3 years ago. The insurance company I was looking into said online to include accidents that were at least 51% your fault and accidents that weren't your fault too. So, if my car got in an accident that would cost $4,000 to fix, which is more than the car is worth, would they pay for the car's value at $3,000 or for its value based on how much it's worth after the damage? I have a ford fester 3 doors that is insured with more than. My dad has a stroke and was getting worse as my mum or dad cannot drive I got a Peugeot 206 with 5 doors so that it would be easier for my mum and dad to get in and out of the car when taking them shopping, I also use the car when my partner is using my ford fester. My son (NAME DRIVER) uses my Peugeot 206 to go to and from college this is 3 days a week. Out of 7 days a week my son uses my Peugeot 3 days to do to college they are the only days he uses it. The crash was not his thought as the car had just pulled out on him when the other car should have stopped. The car that crashed into his span the car around and smashed into the side of him, where the car has impacted him side (DRIVERS SIDE) the seat belt locked so my son had to climb out on the seat belt and get out the passenger side as the drivers door was smashed him. We have a witness and CCTV of what happened. When we called the insurance company (MORE THAN) they asked what happened and my son told them. They then said they will be in touch. That night we had to go to hospital as he is really has back, neck and wrist pains. It has not been 27 days since the crash and since then we have found out that we have been investigated for fraud has they are saying we lied about the amount of car in our house hold. My partner has 1 work van, 1 car that is on a classic insurance, and then I have 2 cars. When taking out the new insurance policy for my Peugeot I only said I have 1 car and that was the ford fester which I did, however is I was doing a new policy for me in my name I didt know I had tell them about other cars that my partner has. Now they are saying the under writer have sent u a letter saying if you pat 550 we will add the other card onto the policy and also change the name over to your sons name and u can say he is the main user. HE ANY THE MAIN USER 3 DAYS A WEEK HE USES IT THEN I USE IT THE REST. So they are kinds of bribing me? I have been gathering quotes for car insurance online on confused and was delighted to see the price down at 615 for once as I have been getting car insurance every year since the age 18 and it has always been over 1000. However, just having a quick check over my details to make sure everything I had entered was correct and then I noticed I had ticked the resident from birth box. I was born in Spain as my mother went over there to work and then had me. I was born in 87 and she took me back home in 88 or 89 roughly. (She is a full British citizen born and raised in UK). As I have no contact with my father and I don't even remember being in Spain or nor can I even speak the language well, I feel fully British and also am regarded as a British citizen. My mum also registered me at a british consulate in april 88, just 6 months after I was born. So I put on the form that I became a resident in 1988. I then calculate the prices again and the insurance quotes shoot up with 955 being the cheapest and the rest going up to 1000. I then think back to all the years I have been paying the insurance and building up my no claims and being the perfect driver with no claims despite having to pay the shocking premiums that young people have to pay and this makes me absolutely livid that my insurance goes up by 340 to 400 based on the fact that I was born in Spain and spent 1 year of my life there and the rest of the 23 years as British Citizen raised here. I am just wondering if I could get away with just going ahead and saying that I was a resident from Birth as I have a baby on the way and really wish that my premiums were a reasonable ammount for once or I should go through it and just demand that they bring the premiums down to the 615 like originally quoted! Making a New Auto Insurance Quote versus Renewal on Same Insurance Company Costs Less? My auto insurance will expire very soon and I noticed that I haven't received any renewal offers from my current insurance provider. So without hesitation I visited their official site and did some new quote. Virtually, I am a new customer if I choose to purchase this quote -- which will cost me only $380.00 Two days later, I finally received a renewal offer via e-mail. Take note again that this is the same insurance company, same insurance policy coverages, same policy number -- But there's a difference! To renew, it'll cost me $518.00 To my startled mind, I made a quick visit on this existing policy account online and checked the declarations page for this renewal offer. Unfortunately for some reason, the website cannot display this said page. What's going on here? Could there be a conflict if I choose to buy a new policy with presumably will make a new policy number with the SAME insurance company? Is there some sort of money making scheme going on in here? I have been informed also that if you create a new quote, and purchase that new quote BUT from the same company you appear as a virtual new customer but having the same name and complete information. Is doing so ok?

I was leaving a parking lot, left too fast, and I fishtailed into a parked car (no one was in the parked car and I was not injured). When I pulled over and got out, a police officer who was a block away immediately asked if I was drinking. I was and admitted it. I was administered a field sobriety test and later a breathalyzer. I blew a 1.1 and was booked for OWI. I called my insurance company about the crash to get the claim started, but did not mention the arrest since they did not ask...but I know this will come up. I have full coverage...so will the insurance cover damages to my car and the other car?

I am a new driver, I am still living with my dad so I was obligated to put him onto my insurance plan because we are living int he same building and both have access to my car, as a new driver I have 0 tickets, 0 cancellations of insurance (have had previous insurance for a motorcycle with the same company) and I must also put 0 experience. now my dad has over 30 years driving experience, but he had 1 ticket in the past 3 years. So this is what the insurance company said to me on the phone, We are refusing your policy because you are a new driver, and your secondary driver has had 1 ticket in the past 3 years. Me, and my father both think that this is just an excuse to not insure a new driver. I am insured now and have been for the past several months driving everyday to and from work, my insurance is getting a bit costly now and am thinking of trying the other company again. I would like to know, Can the insurance company refuse me for those reasons? State Farm charged me the smoker's rate and said I can get it reevaluated in 1 year. My agent told me I should have lied since it was just the 1 cig. I called an Allstate agent and she says I can go thru her and just say no this time when asked by the underwriters about smoking. i was looking around for auto insurance to see if there was anything cheaper than what im paying now. im a 20 year old male with a 2005 scion tc. i have been driving for about 2 years and currently use state farm. when i first insured my car 2 years ago, i was paying $148/mo. due to a speeding ticket, it has risen to $194/mo. i also have comprehensive and collision with a $500 deductible. $100,000/$300,000 coverage with full glass also. not complaining, i think this is great i looked at nationwide, allstate, geico, and progressive. these companies are supposed to be so great, but progressive quoted me at $485/mo for the same coverage! the other companies where all in that general area. progressives state minimum coverage plan for me was almost $300/mo. why do these other companies cost so much more? im not complaining about mine, obviously im not gonna switch, but i am curious as to the difference in price.
